By accessing or using Voco, you agree to these Terms of Service. Voco is a product of GoldenKall. If you do not agree, do not use the service.
You accept these Terms by the earliest of: (a) signing an order form or service agreement that references these Terms; (b) completing account provisioning; or (c) setting or changing your account password upon your first authenticated login. Where an account is provisioned on your behalf, your first authenticated login and the setting of your password constitute your acceptance of these Terms, including the assumption of risk in Section 12. Your acceptance is recorded together with the version of these Terms then in effect, and we may require renewed acceptance when these Terms materially change.
Voco is a restaurant-focused voice automation platform, provided by GoldenKall, that handles inbound phone calls, processes orders, schedules reservations, and integrates with POS and calendar systems.
To use Voco, you must be a business owner or authorized representative of a restaurant and provide accurate account, billing, and operational information. You are responsible for maintaining the security of your account credentials.
Voco may connect to third-party services such as Google Calendar, POS providers, reservation systems, telecom carriers, and analytics tools. You authorize us to access and use data from those services on your behalf, and you represent that you have the right to grant such access.
By using Voco, you consent to call recording and transcription of restaurant phone interactions for order accuracy and operational improvement. You also consent to receive SMS messages for service notifications, as described in our Privacy Policy.
Service fees are billed according to your selected plan and usage. All payments are due when invoiced. Unless otherwise stated, fees are non-refundable.
Free Trials. Any free trial or evaluation period is provided strictly "as is" and "as available," with no service-level commitment, uptime guarantee, or warranty of any kind. We may modify, suspend, or end a trial at any time. Because no fees are paid during a trial, our liability for the trial period is limited accordingly under Section 11.
Active Subscriptions. A paid subscription does not create any warranty, uptime guarantee, or service-level commitment except as expressly stated in a separate written service-level agreement signed by GoldenKall. The disclaimers in Section 10, the assumption of risk in Section 12, and the liability limitations and cap in Section 11 apply equally to free trials and paid subscriptions.
GoldenKall may suspend or terminate your access if you violate these terms, fail to pay fees, or engage in abusive behavior. You may cancel your account by following the account closure process in the dashboard or by contacting support.
GoldenKall and its licensors retain all rights, title, and interest in Voco, the platform, software, documentation, and related intellectual property. You retain ownership of your restaurant data and content submitted through the service.
The service is provided "as is" and "as available." GoldenKall disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and noninfringement. We do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by law, GoldenKall will not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business, lost data, reputational harm, or any missed, dropped, delayed, duplicated, or inaccurately captured orders, reservations, or calls — whether occurring during a free trial or a paid subscription. Our aggregate liability for any claim is limited to the amount you paid to GoldenKall in the three months prior to the claim.
Voco answers calls only when you choose to forward your phone line to it. Activating, configuring, and deactivating call forwarding is entirely within your control, and you may revert your line to staff, voicemail, or any other handling at any time. By forwarding your calls to Voco, you acknowledge and accept the operational risks of automated call handling, including the possibility that an order, reservation, or call may be missed, delayed, incomplete, or inaccurately captured for reasons including telephony and carrier outages, internet or power failures, third-party service interruptions, or limitations inherent to automated voice technology.
You are solely responsible for monitoring your call handling and for maintaining an independent fallback method (such as staff answering or voicemail) so that you can receive orders and reservations if Voco is unavailable or does not meet your needs. GoldenKall does not guarantee that any individual call, order, or reservation will be answered, captured, or completed.
You agree to indemnify, defend, and hold GoldenKall harmless from claims arising out of your use of the service, violation of these terms, or infringement of third-party rights.
These terms are governed by the laws of Tennessee, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Knoxville, Tennessee.
We may update these terms from time to time. Continued use of Voco after changes means you accept the revised terms.
